Terms of Service
Version 2.0 · Effective 26 September 2026
These terms apply to restaurants and cafés that use Restro OS. They explain what you can expect from us and what we expect from you.
1. About these terms
These Terms of Service (“Terms”) govern your use of Restro OS, a restaurant management and ordering platform operated by Rising Web LLP (“we”, “us”). By creating an account or using the Service, you agree to these Terms on behalf of your business (“you”, the “Restaurant”) and confirm that you have read our Privacy Policy. If you don’t agree, please don’t use the Service.
Customers who order from a restaurant on myorder.is are covered by separate Terms of Use for diners.
2. Definitions
- Service — the Restro OS dashboard at app.restroos.io, the diner ordering pages at myorder.is, the staff mobile app, and related features.
- Diner — a customer of your restaurant who views your menu or places an order through the Service.
- Restaurant Data — menus, prices, images, orders, staff details, Diner data and any other content you or your Diners put into the Service.
- Plan — the subscription tier you choose, with the features and fees shown at signup or in your order form.
3. Eligibility, account and team
- You must be at least 18 and authorised to bind the business you register.
- You must give accurate business details, including legal name, address and GSTIN where applicable, and keep them current.
- We may verify your details and may refuse or suspend an account that gives false information.
You sign in with your email address using a one-time code, so no password is stored. Keep access to your email secure and tell us at [email protected] if you suspect unauthorised access. You are responsible for everything done under your account, including by staff you add.
The person who creates the restaurant account is its owner. Owners and managers can invite team members and give them a role (manager, cashier, chef or waiter). You are responsible for the people you invite, for the access you give them, and for removing anyone who should no longer have access. An email address can belong to only one restaurant account at a time.
4. Free trial, fees and billing
- New accounts get a 30-day free trial unless your order form says otherwise. We may end or change trial offers at any time for new signups.
- After the trial, you pay the fees for your Plan in advance, monthly or yearly, as invoiced. Fees exclude GST and other applicable taxes, which you will pay in addition.
- Invoices are due within 7 days. If payment is late by more than 15 days, we may suspend the Service after giving you notice.
- Fees are non-refundable once a billing period starts, except where the law requires a refund or we state otherwise in writing.
- We may change fees with at least 30 days’ notice. The new fees apply from your next billing period.
5. Your responsibilities
- Licences and compliance. You hold and maintain all licences and registrations your business needs, including your FSSAI registration or licence (whichever applies to you), and you comply with food safety, consumer protection, tax and labelling laws.
- Menu accuracy. You are solely responsible for menu items, prices, taxes, allergen and diet labels (such as veg/non-veg markings), images and availability shown to Diners.
- Orders and service. The contract to supply food is between you and the Diner. You are responsible for accepting, preparing and fulfilling orders, for payment collection, refunds, and for Diner complaints about food or service.
- Diner data. You collect Diner personal data for your own purposes and are its Data Fiduciary under the Digital Personal Data Protection Act 2023. You must give Diners any notice and obtain any consent the law requires, and use their data lawfully.
- Content rights. You have the rights to all logos, photos and text you upload, and they do not infringe anyone else’s rights.
6. What you can’t do
You agree not to:
- use the Service for anything unlawful, fraudulent or misleading;
- send spam or unsolicited messages to Diners, or message them without the consent the law requires;
- try to access other restaurants’ data, probe or bypass security, or overload the Service;
- copy, resell, reverse engineer or build a competing product from the Service;
- upload malware or content that is obscene, defamatory, hateful or infringing; or
- share your login with people outside your team, or use someone else’s account.
We may remove content or suspend accounts that break these rules, as required by the Information Technology Act 2000 and its rules.
7. Third-party services
The Service relies on providers for hosting, database, messaging, payments and analytics. Their own terms may apply to features that use them. We are not responsible for outages or acts of these providers, but we choose them with reasonable care. Any links to other websites are provided for convenience only.
8. Data and privacy
- You own your Restaurant Data. You grant us a limited licence to host, process and display it only to provide, secure and improve the Service.
- For Diner data, we act as your Data Processor: we process it only on your instructions, as described in these Terms and our Privacy Policy, and apply reasonable security safeguards.
- We may use aggregated, de-identified data that cannot identify you or any Diner to run analytics and improve the Service.
9. Our intellectual property
The Service, including its software, design, name, logos and documentation, belongs to Rising Web LLP or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Feedback you give us may be used freely without obligation to you.
10. Availability and support
We aim to keep the Service available and will try to schedule maintenance outside peak restaurant hours. We do not guarantee uninterrupted or error-free operation, so keep your own records of anything critical to your business, such as tax invoices. Support is available at [email protected].
11. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose. We are not a party to transactions between you and your Diners.
12. Limit of liability
- We are not liable for indirect, incidental or consequential losses, including lost profits, revenue or data.
- Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.
- These limits do not apply where the law does not allow them, such as for fraud or wilful misconduct.
13. If a claim is made against us
You will indemnify us against claims, fines and costs arising from your food, menu content, treatment of Diner data, breach of these Terms, or breach of law.
14. Term, suspension and termination
- These Terms apply while you have an account.
- You may cancel at any time by writing to [email protected]; cancellation takes effect at the end of the current billing period.
- We may suspend or terminate your account for non-payment, a material breach not fixed within 15 days of notice, or immediately for serious misuse or where the law requires it.
- After termination you can export your Restaurant Data for 30 days. After that we will delete it, except what we must keep by law (for example, invoices under GST law).
15. Changes to these Terms
We may update these Terms. We will notify you by email or in the dashboard at least 15 days before material changes take effect, and the version and date at the top of this page will change. Continuing to use the Service after that means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of India. The parties will first try to resolve disputes through good-faith discussion for 30 days. Unresolved disputes go to arbitration by a sole arbitrator under the Arbitration and Conciliation Act 1996, in English. Subject to this, the courts in India have exclusive jurisdiction.
17. Grievance Officer and contact
For complaints about the Service or content on it, contact our Grievance Officer. We will acknowledge complaints within 24 hours and resolve them within 15 days.
